Internet and Law: Providers may avoid responsibility for pirate content

The new draft of amendments to the Civil Code includes an article which specifies conditions under which providers can avoid responsibility for infringement of intellectual property rights when releasing content.

Provider will be freed from claims on the part of right holders in case he was unaware of illegitimacy of posted content, but after being notified in written form on the violation he took prompt actions. The draft of the law on Internet providers (which has not been adopted yet) reads that illegal content must be removed within three days.

On preparation of amendments, which would enable to bring a provider to account for intellectual property rights infringement when refused to remove illegal content, became known in spring 2010.
